Time and location of Auction: The “Variety Charity House & Land Auction” will take place at 27 Welcome Parade, Wyndham Vale VIC 3024, at 11.00am AEST on Saturday 10 August 2019 (Auction). The Auction will be conducted by Oliver Hume Real Estate Pty Ltd, ACN 158513190 of Level 2, 4 Riverside Quay, Southbank, Victoria 3006 (Oliver Hume).

Subject of Auction: At the Auction, bidders will have the opportunity to bid for the purchase of:

  • a) one land lot located at the Jubilee development, being Lot 240 (being the land contained in Certificate of Title Volume 11660 Folio 787) 27 Welcome Parade, Wyndham Vale VIC 3024 (Land) provided by Lotus Oaks Developments Pty Ltd ABN 71 897 387 383 (Lotus Oaks); and
  • b) a Porter Davis 4 Bedroom Hampshire 23 (with East Harbour façade) (House), provided by BPG Access] Pty Ltd ACN 119 727 043 (Porter Davis), on the Land, (together, the House and Land Package).

Inclusions/Exclusions: Included in the House and Land Package are the floorplan, features and all inclusions on display in the House at the Land prior to the Auction, or as otherwise notified in the Contract of Sale. Images of a similar house to the House that may be used on this website or in any other medium are provided for illustrative purposes only, furnishings and water features are excluded, and landscaping may differ from that shown at the display home.

Fundraising: The profits of the Auction (being the purchase price, less the Reserve) will be donated to Variety - the Children's Charity of Victoria ABN 80 145 257 414 (Variety). Variety is a registered charity. Variety is registered as a fundraiser under the Fundraising Act 1998 (Vic) Reg No. 14275 To the extent that Lotus Oaks, Porter Davis or Oliver Hume may be deemed to participate in any fundraising appeal or other connected activity in connection with the Auction, they do so only as agents of Variety.

Winner: A reserve price will be set for the Auction (Reserve), and the bidder offering the highest valid bid, as determined by the auctioneer, will be declared the winner of the Auction and purchaser of the House and Land Package. The purchaser will be required to sign the Contract of Sale in respect of the House and Land Package, and any other document reasonably required, immediately following the conclusion of the Auction, and to provide payment in the form of a deposit representing 10% of the purchase price on signing the Contract of Sale. The House and Land Package will be settled in accordance with the Contract of Sale, and subject to any specified conditions. The balance of the purchase price will be payable, in the proportions nominated by Lotus Oaks and Porter Davis, on delivery of the House and Land, respectively, and otherwise in accordance with the terms of the Contract of Sale. The purchaser is responsible for payment of all taxes (including land tax and any other duties) and any legal costs or transaction fees in respect of its purchase of the House and Land Package. No cooling-off period applies. A copy of the Contract of Sale and Vendor’s Statement are available for viewing on request.

Further conditions: Visitors to the display home and participants in the Auction may be filmed and photographed and images and footage may be used by Lotus Oaks, Oliver Hume, Porter Davis and Variety at each of their discretions. Bidders in the Auction may register their details online prior to the Auction, however registration is not a condition of participation in the Auction. The winner is purchasing the House and Land Package as described in the Contract of Sale and Vendor’s Statement, which will supersede and replace all prior representations. No part of the House and Land Package may be taken separately.

Images, dimensions, sizes and areas, facilities, amenities, infrastructure, number of land lots, the configuration of these and other information displayed on this website may change depending on a range of variable factors including but not limited to council building approvals and planning consent, market conditions, finance and government and municipal requirements. House decorator items, other furnishings and curtains are not included in purchase price. Refer to the Contract of Sale for details relating to the specifications of the land and house. Lotus Oaks, Porter Davis and their associated entities do not accept any liability for any reliance upon this website.
